Fabric Genomics’ EU-UK Privacy Notice

This EEA and UK Privacy Notice (“Notice”), together with the Fabric Genomics’ (“we,” “us,” or “our”) Privacy Policy, explains how Fabric Genomics’ complies with certain privacy rights specifically available to individuals located in the European Economic Area (inclusive of the European Union) (“EEA”), United Kingdom (“UK”).

Fabric Genomics, Inc complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF as set forth by the U.S. Department of Commerce. Fabric Genomics, Inc has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the Principles shall govern. Individual rights

Residents of the EEA and the UK are entitled to access, delete, correct, withdraw consent, and request the portability of their data. At Fabric, we value privacy protections for all of our customers, and our Privacy Policy explains how you can access, download, and delete your personal data. If you need assistance, feel free to contact us at privacy@fabricgenomics.com. You also have the right to object to or limit processing of your personal data. To exercise these rights, please reach out to us at privacy@fabricgenomics.com. We will respond in accordance with applicable laws, and there may be instances where your ability to access or control your data is restricted by law.

We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To request to limit the use and disclosure of your personal information, please submit a written request to privacy@fabricgenomics.com.

Third-party sharing

Fabric Genomics will not share personal information with third parties without written consent from participants. We comply with all applicable data protection laws, including the Data Privacy Framework Principles, ensuring that any onward transfer of personal data from the EEA and UK adheres to these principles, with liability for onward transfers. Onward Transfer

As a global organization with its headquarters in the United States, your personal data may be transferred, stored, and processed in countries outside your place of residence, including the U.S. When we transfer data internationally, we rely on legal mechanisms to ensure these transfers are lawful, such as fulfilling agreements with you. All transfers from the EEA and UK comply with the Data Privacy Framework Principles, including provisions concerning onward transfer liability.

Inquiries and complaints

In compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, Fabric Genomics, Inc commits to resolve complaints about our collection or use of your personal information transferred to the U.S. pursuant to the EU-U.S. DPF. Fabric Genomics, Inc has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit BBB National Program for more information and to file a complaint. This service is provided free of charge to you.

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. See here.

Enforcement

Fabric Genomics, Inc is subject to the investigatory and enforcement powers of the Federal Trade Commission.

In certain situations, Fabric Genomics, Inc may be required to disclose Personal Information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
